This Privacy Policy describes how HighGuard.cloud collects, uses, discloses, and protects personal information obtained when using our services (the "Service"). By using our Service, you agree to the collection and use of information in accordance with this policy.
1. Purpose & Scope
HighGuard.cloud provides backup and restore of GoHighLevel (GHL) data. We act as a data processor, while your agency is the data controller (they decide what gets backed up). Agencies must secure any required consumer consent before backup. We process data only on behalf of agencies and do not independently collect client data.
2. Data We Process
Depending on your settings, we may process:
- HighLevel Data: Contacts, opportunities, appointments, custom object records from an agency’s GHL account.
- Account Data: Agency account email, billing contact, timestamps.
- Support Data: Error logs, sync metadata, anonymized diagnostics.
We do not collect marketing or payment card data. We do not sell or rent your data.
3. How We Use Your Data
We use data for:
- Performing daily & on-demand backups, and one-click restores where permitted
- Generating export files (CSV, JSON, ZIP)
- Operating dashboard and syncing system
- System monitoring, diagnostics, and customer support
4. Legal Basis
Where applicable (e.g. GDPR), we rely on the following legal bases for processing:
- Contracts: Data necessary to provide the Service
- Legitimate interests: For platform functionality and support (agencies may object)
- Consent: If required by jurisdiction, agencies must secure this
5. Data Retention
- Backups: Retained for 30 days by default.
- Upon cancellation: We retain backups for 30 days post-cancellation; then permanently delete them.
- Logs & anonymized meta: Retained up to 90 days for audit purposes.
6. Security & Storage
We implement industry-standard safeguards:
- Encryption in transit (TLS/HTTPS) and encryption at rest.
- Access controls, secure hosting (e.g. AWS, Atlas), and routine backups.
- While we strive for security, no system is infallible — we disclaim liability for breaches outside our control.
7. Data Disclosure & Sharing
We do not share personal data except:
- With subprocessors (e.g., hosting/storage partners) under confidentiality agreements
- When required by law (e.g., subpoena, court order), or to enforce our policies
- In the context of a business transfer — with prior notice
8. International Data Transfers
Data may be transferred and stored outside your jurisdiction (e.g., across global data centers). By using our Service, you consent to these transfers under applicable privacy laws.
9. User Rights
Depending on applicable laws, individuals may have rights including:
- Accessing or requesting copies of their personal data
- Rectifying or correcting it
- Requesting deletion (where backup includes such data)
- Restricting or objecting to processing
- Data portability requests where applicable
The agency controls client data and should handle these requests. We will support agencies in complying with legitimate requests.
10. Cookies & Tracking
Our site uses functional, non-identifying cookies only (e.g., essential for login, analytics). We don't track users across sites or sell behavioral data.
11. Children’s Privacy
We do not knowingly collect personal data from individuals under age 16. Agencies must not use the Service for data involving minors, unless compliance is assured under applicable law.
12. Disclaimer & Limitation of Liability
- Service is provided “as is”, without warranties of uninterrupted or error-free performance.
- We disavow warranties (express or implied), including MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.
- To the fullest extent permitted by law, HighGuard.cloud (and its affiliates) is not liable for indirect, incidental, special, punitive, or consequential damages.
- Aggregate cap: Total liability is limited to the amount paid to us in the prior 12 months for the Service.
13. Updates to This Policy
This policy may change. We'll notify agencies via email and update the “Effective Date” accordingly. Continuing use of the Service constitutes acceptance of the updated policy.
